Hearing #2022-15 re: 1020 Preserve Lane

NOTICE IS HEREBY GIVEN that the Zoning Hearing Board of Westtown Township will conduct a public hearing on Tuesday, November 22nd, 2022 commencing at 6:45 P.M. at the Stokes Assembly Hall at the Westtown Township Municipal Building, 1039 Wilmington Pike, this Township.  At the conclusion of the said public hearing, the Board will hold a public meeting at the same place to consider said application and possibly act upon the same and conduct such other business as may properly come before it.

The purpose of the hearing is to receive evidence in reference to the application of Jason M. Allen, the legal and equitable owner of a tract of land known as 1020 Preserve Lane, this Township.  The premises is identified on the maps of the Assessor of Chester County as Tax Parcel 67-5-44.  The premises is located in an area designated on the Zoning Map of Westtown Township as an A/C Agricultural/Cluster Residential District.

The premises contains 0.23 acres of land. There is presently extant upon the premises a single-family detached dwelling, an enclosed deck and an unenclosed deck.  The Applicant proposes to construct, use and occupy a swimming pool and patio.  The proposed improvements would result in encroachment into the side and rear setback mandates.  The Applicant asserts that “in part, because his daughter has a developmental delay and medical professionals have recommended the use of water as a calming tool, the application qualifies as a reasonable accommodation and therefor seeks relief by way of a special exception under the provisions of Section 170-2108 of the Zoning Ordinance and also seeks variance relief or such other relief as may be available to permit the construction, use and occupancy of the project proposed.

The application, together with plans and explanatory material is on file at the Westtown Township Municipal Building, 1039 Wilmington Pike, this Township, where the same may be reviewed without cost during normal business hours and where copies thereof may be obtained at cost of reproduction.

All persons interested may be present and give testimony if they so desire.
