NOTICE – WESTTOWN TOWNSHIP
NOTICE IS HEREBY GIVEN that the Zoning Hearing Board of Westtown Township will conduct a public hearing on Thursday, the 16th day of February 2023 commencing at 6:45 P.M. at the Stokes Assembly Hall at the Westtown Township Municipal Building, 1039 Wilmington Pike, this Township. At the conclusion of the said public hearing, the Board will hold a public meeting at the same place to consider said application and possibly act upon the same and conduct such other business as may properly come before it.
The purpose of the hearing is to receive evidence in reference to the application of Matthew Fanfera, et ux, the legal and equitable owners of a tract of land known as 330 Sissinghurst Drive, this Township. The premises is identified on the maps of the Assessor of Chester County as Tax Parcel 67-4H-93. The premises is located in an area designated on the Zoning Map of Westtown Township as an R-2 Residential District Zoning.
The premises contains 0.53 acres of land, more or less. There is presently extant upon the premises a single family detached dwelling, with a rear deck, a shed, hot tub and above ground pool. The Applicants caused the construction of the rear deck and commenced construction of the above ground pool without first obtaining a permit therefor. Upon noting the apparent absence of the required permit the Zoning Officer issued a notice of violations. The Applicants thereupon applied for a permit retroactively. Upon review of the application, it was noted that the construction as completed and as proposed exceeded the allowable impervious cover for the property. The Applicant thereupon applied for variance relief to permit the retention and completion of the improvements installed and to be completed as proposed. In the alternative, the Applicants aver that a member of the Applicants’ household has a disability and therefore they seek to retain and complete the improvements as constructed and/or completed as a reasonable accommodation and seek relief by way of the grant of a special exception under Section 170-2108D of the Ordinance and further requests any other relief that may be available to permit the completion and use of the project as proposed.
The application, together with plans and explanatory material is on file at the Westtown Township Municipal Building, 1039 Wilmington Pike, this Township, where the same may be reviewed without cost during normal business hours and where copies thereof may be obtained at cost of reproduction.
All persons interested may be present and give testimony if they so desire.
